Universities do not necessarily own researcher's inventions

The Federal court has issued a decision relating to employee researchers, typically academics.

In University of Western Australia v Gray (No 20) [2008] FCA 498 (17 April 2008), the University of Western Australia took court action to obtain ownership of matter developed by the former employee while working at the university.

The court found in the employee's favour based on the employee's obligations as a university employee.

"Absent express agreement to the contrary, rights in relation to inventions made by academic staff in the course of research and whether or not they are using university resources, will ordinarily belong to the academic staff as the inventors under the 1990 (Patent) Act".

"The position is different if staff have a contractual duty to try to produce inventions. But a duty to research does not carry with it a duty to invent."

 
New .ASIA Domain goes live

The new .ASIA Domain has gone live effective 26 March 2008.

The staged allocation of domain names that was limited to governments and owners of existing trade mark registrations has ended and any domain name available is now available on a first come first served basis.

EPO Fees increased on 1 April 2008

The official fees charged by the European Patent Office (EPO) increased on 1 April 2008. Generally, all the fees increased by about 5-10%. However, the claim fees at filing and the renewal fees increased by more than this.

At present, the base filing fee includes 10 claims and an excess claim fee of €45.00 (about AU$75.00) is charged for each claim in excess of 10.

As of 1 April 2008 the base filing fee will cover 15 claims but the excess claims fee increases to €200.00 (about AU$330.00)

Renewal fees also increase on 1 April 2008 by between 18 and 55%. However, if the renewal fee is paid late, the late fee payable will be 50% of the renewal fee, not 10% as at present.

Need to file search results removed
The need to file search results on Australian Patent Applications has, in effect, been abolished as of 22 October 2007 by an amendment of the regulations which excludes all search results. This applies even if the search results are overdue but could be filed with extension fees after 22 October 2007.
